The Content is only for your personal, noncommercial use except for those Products provided for by Melody International Incorporated Sounds.
3. Objectionable Material.
When using the Website, you understand that you may encounter Content that may be deemed objectionable, indecent, or offensive, which Content may or may not be identified as having explicit language or text, graphic designs, and/or photographs. Music of India, LLC/ Melody International will have the right to communicate with you through email id provided by you at the time of registration or /and any of your provided social media accounts. You may update your email preferences in your accounts setting.
6. System Requirements for Usage.
You are responsible for your use of hardware system or software Programs as well as any related fees or expenses to use the internet or access the website or to browse, upload, download, play back the content therein. You have to install available software sometimes. Obtaining of any other product will not be interpreted to guarantee your access to the content. you have to contact customer support team to have information of the specifications of any equipment, Internet access or software required to use the services provided by the Website, your attempt or encourage other's attempt to decrypt, entangle or interfere with any software to get access to the website or use the content will not be permitted. 11. Music of India, LLC/Melody International Incorporated Username Policy
Music of India, LLC/ Melody International Incorporated Usernames are provided on a first-come basis. Two users can not have the same Melody International incorporated username at the same time. Disputes regarding usernames if arisen should be solved by the parties themselves. Music of India, LLC/ Melody International incorporated will not intervene in these disputes. Music of India, LLC/Melody International Incorporated has discretion to permanently remove, reassign, or ask a user to modify his/her Music of India, LLC/Melody International Incorporated Username in situations as follows:
12. User Generated Content
Permission may be granted by Music of India, LLC/Melody International incorporated to the users to create customized landing pages and post or upload content, including mixes, tracks, playlist compilations, performances, videos, pictures, messages, texts, logos, and other content by individual artists, labels, brands, and users for the purpose of sharing with Music of India, LLC/Melody International, Inc users. You are responsible for user content and any consequences thereof. You have to warrant for the uploaded user content that
(A) you own or control all applicable rights to the User Content,
(B) you have the necessary rights to post, upload, transmit or display the User Content on Music of India, LLC/Melody International Incorporated, and
(C) that such User Content, or its use as contemplated by this Agreement, does not:
(i) violate this Agreement, applicable law, or the intellectual property or publicity rights of others.
(ii) imply an affiliation, endorsement, approval, or cooperation with you or your User Content by Melody International Incorporated or any unwilling, or unknowing, third-party, without that party’s written consent, or
(iii) cause injury to any person or entity.
13. Restrictions
The website or its part cannot be used to be uploaded, posted, transmitted, displayed, performed, or made available for any messages or content a) those are illegal, obscene, defaming or threatening. b) violate a contractual confidentiality obligation to any third party c) any political campaigning, that containing software viruses d) that provide links to any unapproved third party sites e)that infringe third party sites or harmful to minors. 14. Music of India, LLC/Melody International Incorporated's Rights.
You agree to allow Melody International Incorporated by your any kind of communication through website, to copy, sublicense, adapt, publicly perform/ display the content for providing and promoting the website and to respond any kind of legal formalities if required. If use of such Content exploits any proprietary rights you may have in such material, you agree that Melody International Incorporated has an unrestricted, royalty-free, non-exclusive, and perpetual worldwide right to do so.

All rights not granted to you in the Agreement are reserved to Melody International incorporated and its licensors.
16. Trademarks.
Except prior written permission from the company /mark owner you are not allowed to copy, display, use any of trademarks, trade names, slogans, logos, or other indicator of origin appearing in the website as they are properties of Melody International Incorporated.
17. Violation of Intellectual Property Rights.
All rights of the authors of the works protected, reproduced, and communicated on this site are reserved. Unless authorized, any use of the Content other than for the purposes stated for herein are prohibited. Any notice regarding your infringement of Melody International incorporated 's or other intellectual property rights or suspicion of the same if recieved will result in termination or suspension of Your account without notice to you. 19. No Responsibility for Third-Party Materials or Web Sites.

20. Indemnity and Waiver.
You are expected to defend, compensate, and innocuously hold Music of India, LLC/ Melody International incorporated and its directors, employees, partners, contractors, agents, licensors, representatives, technology providers, affiliates, against all or any of claims, losses, demands, causes of actions, legal involvements, relating to your breach of agreement and your website and to reimburse them on demand of any loss and damage, and expenses involved. 21. Termination/Cancellation.
It is to be noted that failure to make payment of dues, failure to provide Melody International incorporated with a valid credit card, or with complete and perfect registration data, failure to safeguard your account information, violation of intention and Integrity of its platform or violation of third party 's Intellectual property rights, use of vulgar or offensive languages or images in any profile or uploaded content. In case any of these above said provisions of this Agreement is not complied with, Melody International incorporated has got right to terminate or cancel your account or preclude your access to the Website (or any part thereof) and seek any other lawful remedy available. In such case, you will remain liable for all amounts due under your Account up to and including the date of termination.
22. Governing Law.
This Agreement and your use of the website are governed by the laws of the State of Georgia, USA. Your use of the website may also be subject to other local, state, National or International laws. It is agreed upon by you that exclusive jurisdiction for any claim or dispute with Music of India, LLC/ Melody International Incorporated is residing in the courts of the State of Georgia, United States of America.
23. Disclaimers and Limitations of Liability.
i) It is agreed upon by you that Melody International incorporated may remove or cancel the website or part of it at any time for indefinite period if needed with or without notice to you. ii) there is no warranty given by Melody International Incorporated that any particular CD burner, browser, software, hardware, or portable device will be compatible with the Website, or any Content offered on the Website. iii) No liabilities lie on Melody International Incorporated for any unauthorized use of website or its content. iv) Circumstances Melody International Incorporated will be entitled to the maximum disclaimers or limitation on damages and legality available at law or in equity by such applicable law in such circumstance, and in no event shall such damages or liability exceed US $10.00. v) Content of the website is provided based on availability without any kind of warranties, not limited to the implied warranty of salability, and non-infringement.
